HOW WE HANDLE YOUR DATA

Privacy policy

Last updated: 2 September 2026

1. Controller

The controller within the meaning of the General Data Protection Regulation is Cheyron GmbH, Dillenburger Straße 75, 51105 Köln, Germany. Telephone: +49 [221] 398954-0. Email: info@cheyron.de.

2. Website provision and hosting

Our website and online shop operate on the Wix platform. The service provider is Wix.com Ltd., 5 Yunitsman Street, Tel Aviv 6936025, Israel. When you visit the website, Wix processes, in particular, your IP address, access date and time, content accessed, referrer URL, browser and device information, and technical log data. This processing enables the secure, stable and technically reliable provision of the website. The legal basis is Article 6(1)(f) GDPR; our legitimate interest is the secure and cost-effective operation of our online services.

Wix processes visitor data on our behalf. Israel is covered by an adequacy decision of the European Commission. Where Wix or its subprocessors process data in other third countries, this takes place on the basis of an adequacy decision or appropriate safeguards, particularly the EU Standard Contractual Clauses. Technical log data is deleted once it is no longer required for these purposes, unless longer retention is necessary to investigate or prevent a security incident.

3. Contact and service enquiries

If you contact us by email or through a form, we process your contact details and the content of your message to handle your enquiry. For pre-contractual or contractual matters, the legal basis is Article 6(1)(b) GDPR; otherwise, it is Article 6(1)(f) GDPR. Our legitimate interest is responding to business enquiries. Data is deleted when the enquiry has been fully handled, unless statutory retention obligations apply or the data is needed to establish, exercise or defend legal claims.

4. Orders and contract fulfilment

When you place an order, we process customer, contact, delivery, order, invoice and payment data. Processing is necessary to initiate and fulfil the purchase contract and is based on Article 6(1)(b) GDPR. Where data is processed to fulfil commercial or tax obligations, the legal basis is Article 6(1)(c) GDPR.

To fulfil the contract, we transmit the necessary data to Wix as the shop platform, the carrier responsible for delivery and your selected payment provider. As a rule, we do not receive complete payment card details or login credentials where these are collected directly by the payment provider.

Business correspondence is generally retained for six years and accounting records for eight years. Beyond this, we retain data only while statutory claims remain applicable or where necessary to handle warranty and service cases.

5. Customer account

If you voluntarily create a customer account, we process your email address, your password stored in encrypted form, and the order and address details stored in the account. The legal basis is Article 6(1)(b) GDPR. Your account remains in existence until it is deleted. Order and billing data subject to statutory retention obligations is then restricted for the applicable retention period and deleted afterwards. You can also place an order as a guest.

6. Payment providers

The payment methods available for your order are shown at checkout. Depending on your selection, the data necessary to process payment is transmitted to Wix Payments, the payment provider named there, or PayPal. The legal basis is Article 6(1)(b) GDPR. The selected payment provider’s privacy notice also applies to further processing. For some payment methods, the provider may carry out credit or risk assessments under its own responsibility; details are displayed before you select the relevant method.

7. Withdrawal, returns and warranty

For a withdrawal or a case involving a voluntary warranty or statutory warranty rights, we process your name, contact details, contract or order number, details of the affected goods, and the date and content of your declaration. Processing serves to fulfil the contractual relationship and statutory obligations, based on Article 6(1)(b) and (c) GDPR. Data relating to these cases is retained until the applicable statutory limitation and retention periods expire.

8. Newsletter

If you subscribe to our newsletter, we process your email address on the basis of your consent under Article 6(1)(a) GDPR. Subscription is verified through a confirmation email. You may withdraw your consent at any time with future effect through the unsubscribe link in the newsletter or by contacting us. After unsubscribing, your address is removed from the active mailing list; limited evidence of consent may be retained to defend legal claims until the statutory limitation period expires.

9. Cookies and audience measurement

Technically necessary storage and access on your device takes place under Section 25(2) TDDDG where necessary for a service you have expressly requested. Optional analytics or marketing technologies are activated only after your consent under Section 25(1) TDDDG and Article 6(1)(a) GDPR. You may change your selection at any time through the cookie settings with future effect.

Where Google Analytics is used after you consent, the provider is Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland. Usage, device and event data may be processed. Any processing by Google companies in the USA is based on the applicable data protection safeguards. The specific storage period follows the retention setting in Google Analytics and is shown in the consent dialogue. Google Analytics is not loaded without consent.

10. Your rights

Subject to the statutory conditions, you have the rights of access, rectification, erasure, restriction of processing, data portability and objection. You may withdraw consent at any time with future effect. If processing is based on Article 6(1)(f) GDPR, you may object on grounds relating to your particular situation. You may object to direct marketing at any time without giving a reason.

To exercise your rights, contact info@cheyron.de. You also have the right to lodge a complaint with a data protection supervisory authority. The authority responsible for us is the Landesbeauftragte für Datenschutz und Informationsfreiheit Nordrhein-Westfalen, Kavalleriestraße 2–4, 40213 Düsseldorf, Germany, www.ldi.nrw.de.

11. Obligation to provide data and automated decisions

Data marked as required when placing an order is needed to conclude the contract. Without it, the order cannot be processed. We do not make exclusively automated decisions with legal effects. An independent assessment by a selected payment provider may depend on that provider’s terms.

12. Security and updates

Transmission on this website is TLS-encrypted. We take appropriate technical and organisational measures to protect personal data. This privacy policy is updated when the services used or legal requirements change.

CONTRACTUAL BASIS

Terms and conditions

1. Scope and contracting party

These terms and conditions apply to consumer orders placed through the Constantin Weisz online shop. A consumer is any natural person who enters into a legal transaction for purposes predominantly outside their commercial or independent professional activity. Your contracting party is Cheyron GmbH, Dillenburger Straße 75, 51105 Köln, Germany.

2. Orders and formation of the contract

The presentation of goods in the online shop does not constitute a legally binding offer. You may add goods to your cart, review your entries before submitting your order and amend them using the correction options provided. By clicking “Zahlungspflichtig bestellen” (order with an obligation to pay), you make a binding offer to purchase the goods listed in your cart.

Immediately after we receive your order, you will receive an automatic order acknowledgement by email. This initially confirms only receipt of your order. The purchase contract is concluded when we accept your offer through a separate order acceptance or shipping confirmation by email, or dispatch the goods.

3. Contract language and contract text

The language available for concluding the contract is German. We store the order data and send you the order confirmation, these terms and conditions and the information on the right of withdrawal on a durable medium, particularly by email. Registered customers may also view their order data in their customer account for as long as the account exists.

4. Prices and shipping costs

All prices stated in the online shop are total prices in euros and include statutory VAT. Additional shipping costs are displayed on the product or shipping page and again before you submit your order. Deliveries to countries outside the European Union may incur import duties, customs charges or taxes which are not collected by us and must be paid by the recipient.

5. Delivery and availability of goods

We deliver to the countries selectable during the ordering process. Delivery restrictions are displayed no later than the start of the ordering process. The applicable delivery time is stated on the product page and during ordering. If you order several items with different delivery times, we generally dispatch the order together once the item with the longest delivery time is available, unless otherwise agreed.

If, exceptionally, an ordered item is unavailable despite being shown as available, we will inform you without delay. Any payment already received will be refunded without delay.

6. Payment

The payment methods available for your order are shown at checkout. Depending on availability and delivery country, these include credit or debit card, PayPal, deferred payment offered through PayPal, and SEPA direct debit. Payments may be processed through Wix Payments or the selected payment provider. Additional provider terms are shown before you select the payment method.

7. Retention of title

The goods supplied remain our property until the purchase price has been paid in full.

8. Statutory rights in the event of defects

Statutory rights in the event of defects apply. Your statutory claims for defects exist independently of any additional voluntary warranty and are not restricted by it. These terms and conditions do not agree any reduction of the statutory limitation period for used goods in relation to consumers.

9. Voluntary warranty

Where a voluntary five-year warranty is offered for a watch, its scope, duration, territorial coverage, exclusions and claims procedure are set out in the warranty terms available for the relevant product. Your statutory rights in the event of defects remain unaffected and may be exercised free of charge.

10. Liability

We are liable without limitation for intent and gross negligence, culpable injury to life, body or health, under the German Product Liability Act, and within the scope of any expressly assumed guarantee. For a slightly negligent breach of an essential contractual obligation, liability is limited to damage that was foreseeable at the time the contract was concluded and typical of the contract. Otherwise, liability for damage caused by slight negligence is excluded.

11. Applicable law

German law applies exclusively. For consumers, this choice of law applies only insofar as it does not restrict mandatory statutory provisions of the state in which they have their domicile or habitual residence.

FOR CONSUMERS

Information on the right of withdrawal

Right of withdrawal

You have the right to withdraw from this contract within fourteen days without giving any reason.

The withdrawal period expires fourteen days after the day on which you, or a third party designated by you other than the carrier, take possession of the goods. For a single order containing several goods delivered separately, the period begins upon receipt of the last item.

To exercise your right of withdrawal, you must inform us — Cheyron GmbH, Dillenburger Straße 75, 51105 Köln, Germany, telephone: +49 [221] 398954-0, email: info@cheyron.de — of your decision to withdraw from this contract through an unambiguous statement, such as a letter sent by post or an email. You may use the model withdrawal form below, but this is not obligatory.

You may also submit an unambiguous withdrawal declaration electronically through the “Cancel an order” function permanently available in the footer. Immediately after submission, you will receive an acknowledgement containing the content, date and time of your withdrawal at the email address you provided.

To meet the withdrawal deadline, it is sufficient to send your communication concerning the exercise of the right of withdrawal before the withdrawal period expires.

Effects of withdrawal

If you withdraw from this contract, we will reimburse all payments received from you, including delivery costs, except additional costs arising from your choice of a delivery method other than the least expensive standard delivery offered by us. Reimbursement will be made without undue delay and no later than fourteen days from the day on which we receive your withdrawal notice.

We will use the same payment method you used for the original transaction, unless expressly agreed otherwise. You will not incur any fees for this reimbursement. We may withhold reimbursement until we have received the goods back or you have supplied evidence that you have returned them, whichever occurs first.

You must return or hand over the goods to Cheyron GmbH, Dillenburger Straße 75, 51105 Köln, Germany, without undue delay and in any event no later than fourteen days from the day on which you notify us of your withdrawal. The deadline is met if you dispatch the goods before the fourteen-day period expires. You bear the direct cost of returning the goods.

You are liable for any diminished value of the goods only if it results from handling beyond what is necessary to establish their nature, characteristics and functioning.
